FARMWORKERS’ RIGHTS UNDER STATE EMPLOYMENT LAWS: AN INTERACTIVE MAP

Farmworkers today continue to fight for equal protection under employment and labor laws. This interactive map and database of state laws reveal the discriminatory denial of labor protections in many state laws which contributes to unsafe working conditions, lower wages, and high rates of poverty among farmworkers.

WYOMING - Workers’ Rights


Definition of agricultural worker under state law:

Wage law states “any individual employed in agriculture” is excluded but does not define the term “agriculture.” Wyo. Stat. Ann. § 27-4-201.

Wages and Overtime

Minimum Wage

  • There is a state minimum wage law. Wyo. Stat. Ann. §§ 27-4-201 – 27-4-204.
  • Current state minimum wage is $5.15/hr. (But workers who qualify under FLSA should receive the federal minimum wage, which is currently $7.25/hr.)
  • Agricultural workers are excluded from the state minimum wage. Wyo. Stat. Ann. § 27-4-201(a)(iv)(A).

  • Overtime

    There is no state law regarding overtime pay for private employees.

    Workers’ Compensation

  • Agricultural employers may choose to provide workers’ compensation, but it is not mandatory. (Wyo. Stat. Ann. § 27-14-108)

  • There is a state law regarding pesticide use and safety in agriculture. (registration, license, sale, use).(WYO. STAT. ANN. § 11-5-101 – 119., WY. ADC 01.0005.28)
